e-Shop Terms & Conditions

TERMS OF SALE
These terms form the basis of the contract between you as my customer & Indulgence by Joséphine. These Terms &your Order are considered by me to set out the whole agreement between you & I for the sale of cakes, bakes & sweet treats, also known as the Product(s). It is your responsibility to check all details before paying for and placing your order, as amendments cannot be made once payment has been received.

 


DELIVERY/COLLECTION
 

DELIVERY OF POSTAL ITEMS:
Once the treats have left my premises and are in the hands of a delivery company the delivery is out of my control. I am not liable for any mistreatment of items or any damage of goods due to handling or weather conditions.

 

COLLECTION:
Once you a collection date and time have been agreed, it cannot be altered. A LATE FEE will be charged to you if you are 15mins late which will need to be paid before your order is handed over.


 

CANCELLATIONS, RETURNS & REFUNDS
Once an order has been placed, no refunds, cancellations or credits are allowed. As these are food products made to order, there are no returns, refunds or exchanges for hygiene and health and safety reasons.

 


ALLERGENS & DIETARY REQUIREMENTS
All products are made in a kitchen that handles nuts, gluten & milk, plus all other major allergens. Some products in my Made Without Range may not include certain ingredients, however I cannot guarantee they are “free from” & therefore are not suitable for allergy sufferers.

 


COMPLAINTS
Complaints are very rare & due to the amount of work put into each individual order, I take them very seriously. Any issues must be brought to my attention within 24 hours of collection or delivery to give a fair opportunity to assess the nature of the complaint.


Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof & providing the other party with a prior opportunity to resolve any issues amicably.


Where the complaint is in regard to the quality of the product(s) then the product(s), or remainder of the product(s), must be returned to me as soon as possible & within 24 hours of collection/delivery to ensure that I am able to fairly assess the nature of the complaint. Please note, I can only deal with the client who placed the original order.
 


GENERAL TERMS
All designs & intellectual property rights remain the property of Indulgence by Joséphine’. I reserve the right to use images of your order for any form of advertising including web-based promotions, brochures, galleries, & competitions. If you post and tag me in any content online, I will retain the right to share this content by crediting you as the photo owner. Your order constitutes your purchase agreement constitutes the entire agreement & understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes & cancels all prior agreements, statements, representations, understandings, negotiations, & discussions, whether oral or written, between the parties.


Each of the parties acknowledges & agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty, or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.


In the event that anyone or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity & enforceability of the remaining valid & enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.

The parties agree to submit to the non-exclusive jurisdiction of the English courts. By making payment, you confirm that you have read & agree to be bound by these Terms & Conditions.
